Terms of service
One fixed price for the build and one flat month after it, with what each covers written down here and in your contract.
Who you are dealing with
Garboard at garboard.dev is operated by AEOSearch, LLC, and these terms are an agreement between that company and you. Using the site, writing a plan, accepting a contract or starting a retainer means you accept them. Questions go to paintedalways@gmail.com.
What Garboard does
You describe a site. Garboard writes a plan that names every page, feature and integration and the checks the finished site has to pass, builds the site to that plan, runs the checks, and hands you the code. After launch, a monthly retainer keeps the site hosted, edited and supported. Reading a plan costs nothing, and nothing is built or billed until you approve the plan and accept the contract.
The build and its price
The build has one price, quoted from the approved plan and fixed in the contract before work starts. It does not move while we build. You pay it in two parts, half when you accept the contract and half when you accept the delivery. A build priced at $15,000 or more is paid in three parts: 40 percent at contract acceptance, 30 percent at the build milestone the contract names, and 30 percent at delivery acceptance. The last part is due only after the plan’s checks have passed and you have accepted the delivery.
A revision round adjusts what the contract already names: the words, the images, the order of sections, the colours. The contract defines what one round holds. A new page, feature, integration or kind of data is a change order: it gets a fixed quote by the same rule as the build, from $350, and it joins the contract only when you sign it. Scope changes do not travel by chat.
If the build does not pass its own checks and we cannot make it pass, you do not owe the last part, and we refund what you paid for the work not delivered. We will not ship pretty and broken.
The retainer
The retainer starts when your site goes live on our hosting and is billed monthly, or annually at ten months for twelve. Each plan includes hosting, content edits inside its revision rounds, and support. Anything past a plan’s allowance is a change order or the next plan up; there is no meter. A retainer started in the launch window keeps the monthly rate it signed at for as long as it runs, and switching between monthly and annual billing keeps it too. Any other change to a list price is announced 30 days ahead and applies from your next billing period.
You can cancel at any time from your account or by email. A monthly retainer ends at the end of the month already paid, with no further charge. An annual retainer that ends early is refunded for the whole months left, at one twelfth of the annual price each. A day your site was down because of us is not charged: it is credited against the next period, day for day.
What is yours
The delivered site is yours: the code, the words we wrote for it and the images we generated for it, from the moment the final payment clears. You can export the code from the app at any time, whether or not a retainer runs. We keep a copy only to host and edit the site under the retainer, and we delete it 90 days after the retainer ends. The material you give us stays yours; you grant us the right to use it in your build and nothing more. We show a delivered site in our gallery only with your written yes.
Garboard’s own engine, templates, section recipes and tooling stay ours. Your delivered site carries a licence to the parts of them it uses, with no end date and no further fee, and that licence survives the end of the retainer.
Your material and the law
You confirm that you hold the rights to the text, images and marks you give us, and that the site we build for you will be used lawfully. We decline a brief that asks us to copy another site’s protected expression, to pass a site off as someone else’s, or to break the law, and we say so in writing rather than quietly building something else.
What we do not promise
We promise the plan, the build to that plan, and the checks named in it. We make no promise about search rankings, traffic, revenue or any result that depends on your market. The receipt for each build names what was checked and what was not, and a check that did not run is not a pass. Our liability to you for any claim is limited to the amount you paid us in the twelve months before the claim arose, and neither of us is liable to the other for indirect or consequential loss.
Accounts and ending the agreement
Keep your sign-in to yourself; a session lasts 30 days. You can close your account at any time, and your right to export the code survives it. We may suspend or end service for non-payment after 14 days’ written notice, or at once for unlawful use. On any ending, the sections on what is yours and on what we do not promise continue to apply.
Governing law and changes
These terms are governed by the law of the state where the company named above is organised, and its courts hear any dispute that we cannot settle by talking first. This page carries its effective date at the top. A change that reduces what you get is announced 30 days before it takes effect; your contract keeps the terms in force on the day you accepted it.
